Prosecuting breaches of the NES
Lessons learned while prosecuting under the National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health.
Discussion will be around Gisborne District Councils prosecution in 2023 for breaches of the National Environmental Standards for Assessing and Managing Contaminants in Soil to Protect Human Health. Despite it being a successful prosecution, there was lessons learned. The presentation will share what was good and bad. From the initial complaint through to the judges sentencing.

From the Southwest Coast of Scotland (via London) I moved to New Zealand in 2011. My first role in RMA compliance was at Gisborne District Council in 2011 when I was appointed Team Leader of the District Monitoring and Compliance Team. In 2018 I become Team Leader of Council's district and regional Monitoring and Compliance team and then appointed Compliance Monitoring and Enforcement Manager in 2019.

Rachael is Special Counsel at Cooney Lees Morgan, and practices in the fields of resource management, environmental law and local government law. Rachael advises clients, including a number of local authorities, on a wide range of matters including planning, consenting, regulatory, enforcement and environmental issues. She was co-counsel with Adam Hopkinson in the recent prosecution Gisborne District Council v Kokossis which related to breaches of the National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health.
